Ontario Hydro (now Hydro One) was empowered under Section 48 of the Power Corporation Act to take easements that did not have to be registered on title in the Land Registry Office. Under the Electricity Act, 1998 these unregistered easements are equally as valid as registered easements which allow Hydro One to construct, operate, access and maintain its facilities on lands it does not own. Registered easements can be found by searching title in the Land Registry Office while unregistered easements will not appear on the title of your property and can be found using the Unregistered Easement Inquiries.
